Sample Separation Agreement Without Children



WHEREAS, in consequence of the disputes and unhappy differences between the parties because of their matrimonial problems and otherwise, they have no desire or intent to resume living together as husband and wife; and

WHEREAS, the parties are aware they have the right to be fully, separately, and independently advised of their respective legal rights, remedies, privileges and obligations arising out of the marriage relationship and otherwise by counsel of their own choosing and are desirous of entering into this Agreement for the purpose of confirming, fixing and defining their respective property and matrimonial rights, and all other rights and obligations growing out of the marriage relations and otherwise; and

WHEREAS, the parties each warrant and represent to the other that they and each of them fully understand all of the terms, covenants, conditions, provisions and obligations incumbent upon each of them to be performed by virtue of this Agreement, and that each believes the same to be just and fair in their respective best interests; and

NOW THEREFORE, in consideration of the premises and the mutual promises, agreements, and undertakings herein contained, the parties hereto do covenant, promise and agree, each with the other, in the manner following, that is to say:

1. RIGHT TO LIVE APART. The parties may and shall at all times hereafter, live and continue to live separate and apart. Each shall be free from interference, authority and control, direct or indirect, by the other as fully as if he or she were sole and unmarried. Each may reside at such place or places as he or she may select. Each may for his or her separate risk and benefit, conduct, carry on and engage in any business, profession or employment which to him or her may seem advisable. Neither party shall harass, disturb, interfere with or molest the other.

2. FREEDOM FROM INTERFERENCE. Neither of the parties shall molest or annoy the other, or compel or endeavor to compel the other to cohabit with him or her by any legal or any other proceedings for the restoration of conjugal rights or otherwise, nor shall the said parties harass, disturb or malign each other or members of the other's family.
