New York Divorce Residency Requirements

To meet the New York Divorce Residency Requirements, you must meet at least one of these residency requirements:


  • Both spouses currently live in New York AND the cause of the divorce happened in New York;
  • At least one spouse has lived in New York for the past two years;
  • At least one spouse has lived in New York for the past year AND the couple was married in New York;
  • At least one spouse has lived in New York for the past year AND the couple lived in New York while married; or
  • At least one spouse has lived in New York for the past year AND the cause of the divorce occurred in New York.


  • Grounds For Divorce

    If you do not wish to allege grounds for a divorce, you may choose a No Fault Divorce.

    If you wish to allege grounds for a divorce they are as follows:

  • Cruel and Inhuman Treatment (which can include adultery);

  • Abandonment for at least one year;

  • Living apart pursuant to a Separation Agreement for at least one year.

  • Living apart pursuant to a judgment of separation for at least one year.

  • Confinement in prison.
